Abstract |
The study is dedicated to the outgoing extradition requests and
letters rogatory as the main methods for international legal
assistance in criminal matters used by any country and Republika
Srpska, in particular, which one of the two entities of Bosnia and
Herzegovina [BiH]. Even though focused on the law and practice of
Republika Srpska, the study can serve as an advisory to all other
European countries and entities (such as the other one of BiH,
namely the Federation of BiH) as the legal framework and practical
technology described are valid for any of them. Basically, the
study explains how to professionally apply international
conventions to obtain the extradition of fugitive offenders and
evidence from abroad. The preparation of outgoing extradition
requests and letters rogatory in Republika Srpska and BiH is
decentralized. Such an organization though was justified in the
past when criminal investigations in BiH were conducted by
investigating judges. Today, only prosecutors lead criminal
investigations. This opens the way to the much more efficient
centralized preparation of outgoing extradition requests and
letters rogatory.
